I don’t think it’s going to be straightforward for imported vehicles if you look at the wording carefully!

When the rules change on 20 May 2018, vehicles won’t need an MOT from the 40th anniversary of when they were registered. You can check the date the vehicle was registered online.



Trouble ahead for imports methinks :roll:
They're rubbish them Jap bikes lad they won't last five minutes! you want to get yourself a nice Royal Enfield!

I can understand your point and I'm no expert or specialist on the subject but surly the exemption has been made for vehicles over 40 years old and provided you can prove it is in fact 40 years old it should be eligible.....but who knows how DVLA minds work. A question that needs to be put to the DVLA direct for a definitive answer I think. :?:

Another question, I have several bikes that are eligible but some are not registered as "historic tax class" on the V5. Do I have to send the V5 off to the DVLA for the taxation class to be changed before anything can be done or can this all be carried out at the Post Office for the free road tax and MOT exemption declaration ?

Sorry just seen on another post regarding road tax that you can in fact fill in the historic section on the V5 and sign it and leave it at the post office to send off and get a replacement through the post with the taxation class changed.

Is there a declaration form of road worthiness to complete prior to visiting the post office or can this be filled in at the time of free tax application there and then.

I was told by the DVLA the Historic classification is the key, it's a rolling 40yr age rule and it's based on manufacture date not registered date. If the bike is an import or like my old KH250 sat in a crate unsold for 5yrs the you can get a dating certificate form various club such as the VJMC. I've got 2 early 70's bikes that are imports so qualified over the past 3-4yrs and their status was changed to historic via that method.

A DVLA publication "borrowed" from another forum:
This is the final criteria through for MoT exemption and 'Substantially Modified'

The RTD (Roadworthiness Testing Directive) is the EU ruling and states motorcycles are not eligible until 2022.
However, UK owners WILL be exempted as the DfT (Department for Transport) considers our rules tough enough for their inclusion. The legal basis can be found within the Motor Vehicles Regulations 2017 (Tests / Amendments) which went through Parliament on 14th September 2017.

The categorisation of VHI's is section 7 and states "A vehicle considered to be of historic interest to Great Britain" and which:-
1, Was manufactured for the first time 40 years previously.
2, Is no longer being produced.
3, Has been historically preserved or maintained in it's original condition and not undergone any substantial changes
within the last 30 years in the technical characteristics of it's main components.

If the vehicle is over 40 years old you can tick the box and declare it as a VHI, it will then be exempt from MoT for the following 12 months.

Substantially modified vehicles: the criteria taken into account is:
1, Chassis/frame.
2, Axles or running gear.
3, Any parts still in production.
4, Alteration of the type and/or method of suspension or steering.
5, If the machine is currently in production.

In addition if a vehicle (including a motorcycle)
6, has been issued with a Q plate.
7, is assembled from components of different makes and models of vehicle.
8, Is a reconstructed classic (this does NOT include restored).
9, Is a kit conversion, where new parts are added to an existing machine or to the kit of a manufactured body/frame
which changes the general appearance of the machine.

Any of the above will ensure categorisation as 'substantially modified' and will NOT be exempt.
But if any of the last four types (6,7,8,9) are already taxed as historic and can be proven not to have been modified within the previous 30 years, it will still be considered a VHI.

After seeing on another chat forum that someone had already been able to obtain free road tax without an mot at their local post office, I downloaded form V112 today and signed the confession box to promise to keep the vehicle in a roadworthy condition. The lovely lady at the post office scanned the v5 and even smiled giving me a printed receipt for nil tax and sent my v5 off to dvla for mot exemption update. She did not want to see my insurance certificate, didn't ask any questions about the bike or where it had been for the last 30 years as it was still on the old blue style v5 and had not been taxed or mot'd in that time either(fully restored now though) and just wrote "historic" in the vehicle tax change details. The best things in life are free.. :lol: :lol:

Just looked at form V112 and it only mentions vehicles pre 1960 as being mot exempt was the a suffix on the form to signify that it was an updated one ?

I think that Post Office made a mistake to be honest - lovely lady or not!


Mal the form will be updated to include 40 year old vehicles after May 20th - whether or not it happens ON the day (being a Sunday an all) remains to be seen. If they had the appropriate form up now lots of people would be trying to do the above before the correct date...

Yes I just realised that Simon - it mentions it somewhere amongst all the red tape and goblygook - so look out Monday :lol: I think they are going to be a bit on the busy side :lol:
